1. Acceptance of Terms & Conditions
By accessing and using the Visiku services provided by PT Qavah Karya Mulia (Qavah Group), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Service Description
Visiku is a digital platform providing eye health checks, optical consultations, and technology-based eyewear recommendations. Our services include but are not limited to digital vision tests, consultations with optometrists, lens and eyewear frame ordering, and ongoing eye care programs. Qavah Group reserves the right to modify, suspend, or discontinue certain services at its sole discretion without prior notice.
3. User Obligations
Users must provide accurate, complete, and up-to-date personal and eye health information when using Visiku services. You are responsible for maintaining the confidentiality of your account credentials, test results, and personal health documents shared during the use of the service. Any misuse of the account is entirely the user’s responsibility.
4. Intellectual Property Rights
All content, materials, trademarks, logos, eye examination technology, recommendation algorithms, test result reports, and analytical tools belonging to Visiku are the exclusive rights of PT Qavah Karya Mulia and Qavah Group, unless otherwise specified in a written agreement. Reproduction, distribution, modification, or creation of derivative works from our proprietary materials without written permission is strictly prohibited.
5. Limitation of Liability
Visiku is not liable for any direct, indirect, incidental, consequential, or special losses arising from the use of our services, including but not limited to inaccuracies in digital test results, consultation delays, or force majeure, to the extent permitted by applicable law. Digital examination results are indicative and do not replace a professional medical diagnosis.
6. Privacy & Data Protection
We are committed to protecting your personal data and eye health data in accordance with Indonesia’s Personal Data Protection Law (UU PDP) and applicable international privacy standards. All client information, examination records, eyewear prescription history, and health correspondence are treated as strictly confidential. For more information, please refer to our Privacy Policy.
7. Dispute Resolution
Any dispute arising from or related to these Terms and Conditions will first be resolved through good faith negotiation between the parties. If no resolution is reached within thirty (30) calendar days, the dispute will be submitted to the Indonesian National Arbitration Board (BANI) for binding arbitration in accordance with its prevailing rules.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia, including applicable consumer protection and digital health regulations as stipulated by the Ministry of Health and relevant authorities, without regard to its conflict of law provisions.
